POSITION

The Department supports the bill.

PROBLEM/BACKGROUND

Part 401, Wildlife Conservation, 1994 PA 451, authorizes the Department of Natural Resources (DNR) to issue various permits and licenses.  Language authorizing the permit to hunt with a modified bow is somewhat rigid and provides little flexibility to the Department. 

DESCRIPTION OF BILL

SB 572 would allow the Natural Resources Commission (NRC) to issue an order to regulate the taking of game with a modified bow.  Upon issuance of such an order, the statutory provision would no longer apply.

SUMMARY OF ARGUMENTS

Pro

There is a strong interest and desire to recruit and retain hunters.  Increased latitude for issuing permits to hunters with disabilities is desirable.

Delegation of this authority is consistent with the Commission’s exclusive authority to regulate the taking of game, per MCL 324.40113a.

PA 347 of 2000 authorized the Natural Resources Commission to issue an order to regulate the taking of game with crossbows, thereby repealing MCL 324.40115.
